End-to-End Process for Transferable Development Rights (TDR)


From Citizen Engagement to Issuance of Development Rights Certificate (DRC)

1. Introduction to TDR & DRC

Transferable Development Rights (TDR) is a planning mechanism through which landowners whose land is required for public purposes (such as road widening, parks, metro corridors, utilities, and civic amenities) are compensated not by cash, but through development rights that can be used or sold elsewhere.

These rights are issued in the form of a Development Rights Certificate (DRC) by the competent planning authority. The DRC allows additional Floor Area Ratio (FAR) to be utilized or transferred to eligible receiving zones.

2. Phase 1 – Land Identification & Feasibility Assessment

        1. Identification of Land Required for Public Purpose

  • Roads, flyovers, metro, drainage, parks, public utilities, or infrastructure projects as per Master Plan.

        2. Preliminary Survey & Feasibility Study

  • Sukhitva conducts site inspection and document verification.
  • Eligibility under prevailing TDR policy is assessed.
  • Preliminary estimation of eligible FAR and potential DRC value.

        3. Legal & Technical Due Diligence

  • Verification of:
    • Title deeds
    • Encumbrance Certificate
    • RTC / Khata / Mutation
    • Tax paid receipts
  • Identification of risks such as disputes, joint ownership, or litigation.


3. Phase 2 – Engagement with Citizens / Landowners

         4. Landowner Awareness & Counseling

  • Sukhitva explains:
    • Concept of TDR & DRC
    • Benefits over cash acquisition
    • Entitlement calculation methodology
    • Marketability and usability of DRC


        5. Consent & Onboarding of Landowners

  • Collection of consent letter / MoU expressing willingness to surrender land for TDR.
  • Assistance   in collecting and organizing all ownership documents.
  • NOCs  from co-owners wherever applicable.


        6. Joint Survey & Measurement

  • Sukhitva coordinates with government surveyors and engineers.
  • Joint measurement and preparation of official survey sketch confirming exact area to be surrendered.

        7. Preparation of Surrender Plans & Application Dossier

  • Detailed drawings showing surrendered portion.
  • Photographic documentation.
  • Compilation of complete application set as per authority requirements.


4. Phase 3 – Application Submission & Government Scrutiny


        8. Formal Submission of TDR Application

  • Sukhitva submits the application to the Planning Authority / Urban Local Body.

        9. Technical, Planning & Legal Scrutiny

  • Verification by:
    • Planning department (zoning & FAR eligibility)
    • Engineering department (land requirement & measurements)
    • Legal department (ownership & title validation)
  • Sukhitva manages clarifications, revisions, and follow-ups.

        10. Calculation of TDR Entitlement

  • Authority determines eligible FAR based on:
    • Zone and land use
    • Surrender purpose
    • Applicable entitlement ratio (e.g., 1:1, 1:1.5, 1:2)
  • Sukhitva ensures correct entitlement is granted as per rules.


5. Phase 4 – Land Surrender & Government Takeover


        11. Execution of Relinquishment / Surrender Deed

  • Drafting and registration facilitated by Sukhitva.
  • Land legally transferred to Government for public use.


        12. Physical Possession & Mutation

  • Joint inspection confirming possession handed over.
  • Mutation of surrendered land in Government records.
  • Issuance of possession acknowledgement certificate.


6. Phase 5 – Issuance of Development Rights Certificate (DRC)

        

       13. Preparation of Draft DRC

  • Authority prepares DRC indicating quantum of development rights.
  • Unique identification number assigned.

       14. Approval by Competent Authority

  • Final approval by Commissioner / Planning Authority Head.

       15. Issuance & Handover of DRC

  • DRC issued in physical and/or digital form.
  • Sukhitva Consulting Services hands over the DRC to the citizen / landowner, completing the TDR process.


7. Post-DRC Support (Optional Services by Sukhitva)

  • Advisory on sale or transfer of DRC to developers.
  • Market valuation and negotiation support.
  • Drafting and registration of DRC transfer agreements.
  • Assistance to builders for DRC utilization in project approvals.
  • Coordination for partial or full consumption certificates after utilization.
